CONDITIONS OF HIRE

For the purpose of these conditions, the term HIRER shall mean an individual hirer or, where the hirer is an organisation, the authorised representative.  The term COMMITTEE shall mean either trustees of the Hall or other people working on behalf of the trustees.

01.          RESPONSIBILITY.   The Hirer will, during the period of the hiring, be responsible for supervision of the premises, the fabric and contents, their care, safety from damage however slight or change of any sort and for the behaviour of all persons using the premises whatever their capacity.

02           SAFETY.  In the interest of safety, particularly in the event of an emergency evacuation of the building, all passages, corridors and stairs must be kept clear of obstructions at all times.

03.          USE OF PREMISES.  The Hirer shall not sub-let or use the premises or allow the premises to be used for any unlawful purpose or in any unlawful way nor do anything or bring onto the premises anything which might endanger the same or any insurance policies in respect thereof

04.          INTOXICATING LIQUOR.  If intoxicating liquor is to be sold or provided in any way, the consent of the Designated Premises Supervisor/licencee must be obtained when booking. 

05.          GAMING, BETTING & LOTTERIES.  The Hirer shall ensure that nothing is done on or in relation to the premises in contravention of the law relating to gaming, betting and lotteries.

06.          CONDITIONS AND REGULATIONS.  The Hirer shall comply with all conditions and regulations made in respect of the premises by the Fire Authority, Local Authority, or otherwise, particularly in connection with any event which includes public dancing or music or other similar public entertainment or stage plays.

07.          FOOD HYGIENE.  The Hirer shall, if preparing, serving or selling food observe all relevant food health and hygiene legislation and regulations.

08.          ELECTRICAL SAFETY.  The Hirer shall ensure that any electrical appliances brought by him to the premises and used there shall be safe and in good working order, and used in a safe manner. 

09.          DAMAGE.  The Hirer shall indemnify the Committee for the cost of repair of any damage done to any part of the property including the curtilage thereof or the contents of the buildings which may occur during the period of the hiring as a result of the hiring.

10.          THIRD PARTY INSURANCE.  The Hirer shall be responsible for making arrangements to insure against any third party claims which may lie against him or her (or the organisation if acting as a representative) whilst using the Hall.  (The Hall is insured against any claims arising out of its own negligence).

11.          ACCIDENTS.  The Hirer must report all accidents involving injury to the public to a member of the Management Committee as soon as possible (telephone numbers on page 2).  Any failure of equipment belonging to the hall must also be reported as soon as possible to the booking clerk.  Certain types of accident or injury must be reported on a special form to the local authority.  This is in accordance with the Executive Reporting of Injuries, Diseases and Dangerous Occurrence Regulation 1995.

12.          ANIMALS.  The Hirer shall ensure that no animals (including birds) except guide dogs are brought into the hall, other than for a special event agreed to by the Committee.  No animals whatsoever are to enter the kitchen at any time.

13.          CHILDREN.  The Hirer shall ensure that any activities for children under eight years of age comply with the provisions of The Children Acts of 1989 and other subsequent Acts of Parliament and that only fit and proper persons have access to the children.

14.          TRADING.  The Hirer shall, if selling goods on the premises, comply with Fair Trading Laws and any code of practice used in connection with such sales. 

15.          CANCELLATION.  There will be a 50% charge for cancellation with two weeks or less notice and a 100% charge for 24 hours or less notice.

16.          CARE OF PREMISES.  At the end of the hiring, the Hirer shall be responsible for leaving the premises and surrounds in a clean and tidy condition, properly locked and secured unless directed otherwise, all lighting and heating turned off, and any contents temporarily removed from their usual positions properly replaced. 

17.          ELECTIONS.  The Committee reserves the right to cancel a hiring in the event of the Hall being required for use as a Polling Station for a Parliamentary or Local Government election or by-election, in which case the Hirer shall be entitled to a refund of any deposit already paid.

18.          UNAVOIDABLE CANCELLATION.  In the event of the Hall or any part thereof being rendered unfit for the use for which it has been hired, the Committee shall not be liable to the Hirer for any resulting loss or damage whatsoever.

19.          REFUSAL.  The Committee  reserves the right to refuse a booking without notice or to cancel this hiring agreement at any time either before or during the term of the agreement upon giving 7 days' notice in writing to the Hirer.

20.          REIMBURSEMENT.  The Hirer shall be entitled upon such notice to reimbursement of such monies including the deposit or a proportion of the same as have been paid by the Hirer to the Committee.  The Committee shall not be liable to make any further payments to the Hirer.

21.          NOISE.  The Hirer shall ensure that the minimum of noise is made on arrival and departure.

22.          APPLICATIONS.  If an application is made on behalf of a person or organisation then the Management Committee will be entitled to assume that the applicant has the full authority of that person or organisation to do so.  The applicant should be over 18 years of age. 

23.          PAYMENT.  At the time of booking the Hall, the Applicant must pay a deposit of 50% of the booking charge.  The balance must be paid at the latest on the day of the function for which it is booked, and the key of the Hall will not be released until payment has been made in full.   The requirement for a deposit may be waived for regular users at the booking clerk’s discretion.

24.          SETTING UP TIME.  If a user requires access to the Hall prior to the booked period in order to set up then there will be no charge for that setting up time unless this leads to the loss of a paying booking.  If the user requires full and exclusive use of all or part of the Hall for setting up or otherwise then that use is chargeable.

25.          SMOKING. No smoking shall be permitted on the Premises.

26.          LITTER.  Litter shall not be left in the Hall or about the premises.

27.          DAMAGE.  Any damage to the Hall or its contents should be reported to the Management Committee by way of the Complaints Book kept at the foot of the stairs and must be paid for by the person or organisation who booked the hall.

28.          LIABILITY OF THE COMMITTEE.  In view of the public nature of the Hall and the large amount of use made of it, neither the Management Committee nor the Trustees of the hall, nor any person employed by either the Committee or the Trustees shall be liable for loss of or damage to any money or private property of any description whilst it is in the Hall.

29.          POWER TO VARY THESE RULES.  The Committee may add to or vary these Rules either generally or in individual cases as they see fit by giving notice in writing to the person who made the application.  Charges are revised each April, but may, otherwise, be varied at three months' notice.

30.          ITEMS LEFT IN HALL.  Any goods or items left in the Hall are left at the hirer's own risk.  If you are planning to leave anything or delay tidying up after a party, please liaise with the booking clerk to ensure that you do not inconvenience other hirers.
